Taking the handcuffs off the President

ht: B

I’m sure you all have seen in the news where the President has fired people and they immediately go to court to keep their jobs with mixed success.

Apparently this started back in the 30’s when FDR fired a Republican from the Federal Trade Commission. The Supreme Court at that time ruled that he couldn’t be fired and this broad decision created a monster of insane proportions: unelected appointees who could not be removed and who created laws via fiat (aka regulations), thus circumventing our entire system.

As a note, this mess was created by Congress who created ‘independent non-partisan’ agencies that were essentially beyond the reach of the law and had no accountability to anyone.

Well, it looks like the tide is finally turning and this 90 year old mistake by that Supreme Court may finally be made right (as in overturned). There are some signals, such as last week’s 6-3 ruling by the present Supreme Court that said that the President could, indeed, fire members of the Consumer Product Safety Commission.

The 6-3 decision has detonated the foundation of bureaucratic immunity. Trump can now terminate any commissioner who obstructs reform, dismantle ideological mandates, and reclaim executive control over agencies that have operated like private empires. The ruling sets a precedent that can sweep through every corner of the federal maze — FTC, SEC, NLRB, CDC, FDA, DOE. Hundreds of unelected operators who hid behind the term “independent” are now exposed.

According to the article/X post, there are almost 700 people in the federal government who have previously been untouchable. And now they are not. They were the core of the shadow government. And now they can be removed. This is the basis of their fear of Trump and why they tried so hard (and are still trying) to undermine him and keep him sidelined.

Sunshine is the best disinfectant and these folks are going to get a hearty dose.

  1. LBJ in the 1930s?

    Not sure that is correct.

    1. Joe—Thanks for the catch. It was FDR. Too many presidents with initials.

    2. But I do know Billy Jeff Clinton fired all the US Attorneys when he took office in 1993.

  2. LOL… All presidents have intials and thanks for the chuckle. Some are known by their initials more than others for sure. LBJ, JFK, FDR are certainly noted as such.

My favorite? Albeit it’s only TWO letters? BO because… it’s “fitting”. 😉

In the business realm we have “TLA’s”… or Three Letter Acronyms.

In the DOD (Department Of Defense) realm there is the infamous MIL-STD-12 which believe it or not is the official Military Dictionary of? ABBREVIATIONS and it is MASSIVE and is literally like a second language diciontary. Abbreviations to words and words to abbreviations and if you’re working on Technical Documents (Drawings, manuals, etc.) you had better make sure any and ALL abbreviations comport with it!

As to the topic? Well… does it not make sense that the HEAD of and organization has the power to “adjust” the organizational chart as he see fit? Absolutely.

That it was made otherwise defers to the wisdom of someone that was born long after this “Decision” was handed down.

  3. I think this is a case where I don’t think there are any good answers. Yes, I’m glad Trump is able to clean up the swamp. No, I wouldn’t want BO (thanks Boneman) to have the same power.

Normally, I’m of the mind set of “if I don’t want both parties to have the power, I don’t want either party to have the power.” In this case, it’s a reset of the power to hire a partisan that can’t be fired (and I don’t want either party to have power to hire regulators that are beyond civilian control).

Beyond civilians control is precisely why Miley needs to be charged with treason and executed, but I digress.

  4. Good. Fed gov needs a weight loss of over 200 agencies to fit in it’s Constitutional limits. Don’t think Donald’s the guy to do it but if the Supremes go the right way someone will have the power to do so.

  5. On the subject of TLAs, anyone here ever read about MLLs? Muzzle loading lasers…

  6. crazyeighter–That he did.

boneman–It was my bad. I was researching something else. And yes, the head of the country should have the power to hire and fire employees under his purview.

Unferth–Well, that’s what the Republicans thought when they tied FDRs hands. I think that the head of the executive branch should be able to fire anyone and I don’t think there should be any ‘independent’ agencies or commissions.

steves–I’m hoping Donald’s setting up a blueprint for good governance.

    Frank–Thinking this is non sequitur?

  7. In the Constitution there are three branches of government, not three plus a fourth-administrative agencies.

  8. For those playing at home, the Dem Presidents have been doing this for years without anyone whining about it. Remember when BO removed a bunch of republicans from various agencies? And President Autopen’s admin did the same thing?

No whining, no ‘evil democrats firing people’ bullscat.

But Trump do the same thing the Dems do? Game’s over, man, game’s over…

  9. In that case, how about BO is bad, BTO is good?

  10. Well, if you are going to refer to William Jefferson Clinton as “Bill” then that would make him BJ Clinton.

  13. Trying to figure this one out: commenter mentions military TLAs and their oddities. I mention the oddest military TLA I’ve ever ran into. Accused of non sequitur. Hmmmmm….

  14. Frank–Absolutely not sure what lasers have to do with the subject at hand aside from the fact that it is a three letter acronym. That said, no aspersion meant.
