I’m sure you all have seen in the news where the President has fired people and they immediately go to court to keep their jobs with mixed success.
Apparently this started back in the 30’s when FDR fired a Republican from the Federal Trade Commission. The Supreme Court at that time ruled that he couldn’t be fired and this broad decision created a monster of insane proportions: unelected appointees who could not be removed and who created laws via fiat (aka regulations), thus circumventing our entire system.
As a note, this mess was created by Congress who created ‘independent non-partisan’ agencies that were essentially beyond the reach of the law and had no accountability to anyone.
Well, it looks like the tide is finally turning and this 90 year old mistake by that Supreme Court may finally be made right (as in overturned). There are some signals, such as last week’s 6-3 ruling by the present Supreme Court that said that the President could, indeed, fire members of the Consumer Product Safety Commission.
The 6-3 decision has detonated the foundation of bureaucratic immunity. Trump can now terminate any commissioner who obstructs reform, dismantle ideological mandates, and reclaim executive control over agencies that have operated like private empires. The ruling sets a precedent that can sweep through every corner of the federal maze — FTC, SEC, NLRB, CDC, FDA, DOE. Hundreds of unelected operators who hid behind the term “independent” are now exposed.
According to the article/X post, there are almost 700 people in the federal government who have previously been untouchable. And now they are not. They were the core of the shadow government. And now they can be removed. This is the basis of their fear of Trump and why they tried so hard (and are still trying) to undermine him and keep him sidelined.
Sunshine is the best disinfectant and these folks are going to get a hearty dose.
