DA or Defense Attorney?

 It seems that the Democrat DA in Santa Fe is already trying to sow the seeds of doubt that Baldwin pulled the trigger and killed Halyna Hutchins.

According to Vanity Fair, D.A. Carmack-Altwies seems open to accepting Baldwin’s claim that he didn’t pull the trigger on the gun that killed Hutchins and wounded the film’s director, Joel Souza.

TMZ, reporting on Vanity Fair‘s paywalled article, noted that Carmack-Altwies says she has performed tests that she claims shows that the gun could have malfunctioned and the hammer could have hit the cartridge without the trigger being pulled.

The D.A.’s determination is critical in this case because if she buys the story that Baldwin didn’t pull the trigger, that will materially affect any charges that could be filed against the actor.

 So this person, who admits that she knows nothing about guns and who has not said anything about the gun being damaged or rigged in some way that it would fire itself is already tainting the case.  Even if her office does bring charges, it looks like they’ll be half-assed at best and the jury pool will already be biased due to her Vanity Fair utterings.

Money talks and bullshit walks?  Or she’s just a really big fan of 30 Rock?

  1. She's from Mystical Santa Fe. That's what the rest of New Mexico thinks of that town. Roswell is more grounded in reality than Santa Fe.It's what Berkeley is to California or Austin is to Texas.A place where the strange go to breed.I'm sure she FEELS that someone as talented and carrying as Mr. Baldwin would never do something so reckless as to kill someone.Sigh.

  2. Common sense says that pointing the firearm at someone is the cause of the death of Hutchins, but I don't know if “common sense” is any part of the law. Committing a dangerous act might be sufficient for action but not if the D A is prejudiced or a fool. Like many today, she might “blame the gun” instead of the person operating it.

  3. Gerry–There's got to be some weirdness going on. Didn't know that about Santa Fe.NFO–That makes the most sense.Mike-SMO–I think they're trying what I call 'the Clinton defense'. The one where you're having to define what 'is' is. Did he pull the trigger or did he otherwise mishandle the firearm? And of course they are going to blame the firearm…

  4. NM has become a place for Hollywood to film, and it's the loss of those dollars that's driving whether to charge Baldwin.
