Broke privacy rules, keeps her license

I don’t know if y’all remember the Indiana abortion doctor who provided enough identifiable information regarding one of her patients that the media was able to track down the girl and her mother, but just in case, here’s the background.

The girl’s story appeared in a July 2022 IndyStar article about reduced abortion access following the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health.”

Considering the fact that this information was enough to track the girl down (best practice indicates that no cohort of less than 5 should ever be reported), it was pretty clear that she violated HIPAA and privacy laws even though the information given to the IndyStar was age, gender, and state.  In this case, she was a cohort of 1–therefore easily identifiable.

The abortion doctor, who apparently felt that the political gain was worth more than the privacy of a little girl who had been raped.  She was found to have violated privacy laws and received a slap on the wrist.

She’ll still be allowed to practice with merely a reprimand on her record.

Justice denied.

  2. As a retired nurse I find that appalling and unethical. I would refuse to work with her and urge other medicos to also refuse and if I am around her patients would inform them that she discloses enough information for identification. I would file grievances and incident reports every chance I get(harassment, yes) to the hospital and her bonding company until she quits and also file malpractice and ethics violations to she runs screaming.
