Moving forward with justice in North Carolina

The North Carolina Supreme court, along party lines, ruled that a mother’s lawsuit against her son’s school district and the doctors who ran a covid testing a shot clinic after he was given a covid shot without parental permission.

From the AP:

Smith went to the clinic to be tested for COVID-19 after a cluster of cases occurred among his school’s football team. He did not expect the clinic would be providing vaccines as well, according to the litigation. Smith told workers he didn’t want a vaccination, and he lacked a signed parental consent form to get one. When the clinic was unable to reach his mother, a worker instructed another to “give it to him anyway,” Happel and Smith allege in legal briefs.

Happel and Smith sued the Guilford County Board of Education and an organization of physicians who helped operate the school clinic, alleging claims of battery and that their constitutional rights were violated.

Both the school and the ‘doctors’ are claiming immunity under the federal PREP act which was passed in 2013 and invoked in 2020. This act gave pretty broad ‘qualified immunity’ to pretty much everybody.

Like any broad immunity, can be used to run roughshod over the populace without worrying about reprisal. Which basically sets up a framework for tyranny.

Considering the fact that many Constitutional protections were put on hold under the aegis of this the PREP act we can only hope that this immunity that was so broadly overused can be overturned and that petty tyrants get some comeupance.

  1. Immunity my ass. The person authorizing the injection and the person performing the injection should both be incarcerated. The school system and the physician organization involved should have to cough up a ton of cash to the victim. Firings need to occur. Medical licenses need to be revoked. The court’s party-line vote once again proves Democrats want total control of your life and/or death.

  3. Public Health people just BELIEVE….whatever their current mission is they do whatever they can to do it.

    There is no thought, no logic. They are like Missionaries in their quest to Do Good and complete what they have been told to do.. Legalities like “permission slips” be damned.

    It is why I never trust the Public Health people. They don’t really think, they just complete the mission.

    That wouldn’t have happened to a tough kid, or even an independent thinker, except by force, and a tough parent would’ve put them in the dirt.

    At some point, Americans need to stop being cowards. I’m not holding my breath.

  6. Extending crazyeighter, remember John Roberts trying to convinced us that there is no such thing as a Republican judge or a Democratic judge.

    If the judiciary wants to be respected, perhaps they should try being respectable.

    wv–I am surprised the kid didn’t walk out but he probably got caught by surprise.

    crazyeighter–Yeah. Judges are supposed to uphold the Constitution, not be backup for a particular party.

    Unferth–And then Roberts’ action completely negate that assertion.

  8. when I was in school you could not do anything without written permission from my parents. Even a simple field trip. Much less injections!!

    Unless there are public arrests, trials, convictions and executions of scum like this, the current reprieve will soon be over and the next step is gulags and extermination camps. This is coming anyway. Better to have Nuremberg II for a while than Auschwitz II, eh?
