Seeing the writing on the wall, Biden’s Department of Education has decided to NOT finalize the transgender rule that the NCAA and others have been hiding behind in order to allow men and boys into women’s and girl’s sports.
The department said it now does not “intend for a final rule to be issued,” per NBC News. If the administration had not withdrawn its proposal, it would have been easier for President-elect Donald Trump’s administration to tweak the rules for their own agenda.
The department also said that it made its decision because of ongoing litigation over the rule change, and because there were 150,000 public comments with modifications suggestions that needed to be considered.
Schools will retain the right to decide which teams trans athletes can join after the latest Biden U-turn.
The Biden administration on Friday withdrew a proposed rule change that would have stopped schools from banning transgender athletes from teams matching their gender identities.
This doesn’t override state law, like in California. But considering the fact that there were injunctions against the proposed rule in 26 states that the Supreme Court allowed to stand, there’s a good chance that changes will be pending in the other 24.
